Abhishek Lodha Sues Younger Brother For Using ‘Lodha’ Surname For Brands

Family disputes in business dynasties often attract public attention, and the ongoing conflict between the Lodha brothers—Abhishek Lodha and Abhinandan Lodha—is no exception. The battle over the usage of the Lodha trademark has now taken a new turn as their mother, Manju Lodha, has stepped in, urging her sons to resolve their differences in accordance with the 2017 family agreement.

In a heartfelt letter, Manju Lodha, wife of Maharashtra cabinet minister Mangal Prabhat Lodha, has appealed to her sons to uphold family values, avoid public disagreements, and respect the legally binding settlement they agreed to years ago. She emphasized that neither of them has any right over the other’s business, as per the family arrangement made in March 2017.

This high-profile dispute has also reached the Bombay High Court, with Macrotech Developers, run by Abhishek Lodha, filing a ₹5,000 crore lawsuit against the House of Abhinandan Lodha, citing trademark infringement. A former Supreme Court judge has been appointed as a mediator in the case.

The conflict between Abhishek Lodha, the head of Macrotech Developers (formerly Lodha Developers), and Abhinandan Lodha, who leads House of Abhinandan Lodha, is centered around the right to use the Lodha brand name in business.

  • The separation: In 2015, Abhinandan Lodha parted ways with the Lodha Group and started his own real estate business.
  • The agreement: In 2017, a formal family settlement was signed, clearly defining ownership rights.
  • The lawsuit: In 2024, Macrotech Developers sued the House of Abhinandan Lodha for alleged trademark infringement and sought ₹5,000 crores in damages.
  • The mediation: The Bombay High Court appointed former Supreme Court Justice RV Raveendran to mediate the dispute.

In her letter dated March 1, 2024, Manju Lodha urged her sons to respect each other and abide by the 2017 family agreement, which clearly outlines the division of businesses and intellectual property rights.

Key Points from Her Letter:

  1. Respect the Agreement – She reminded them that the Amended Family Agreement (2017) states that each brother has no rights over the other’s business or assets.
  2. Avoid Public Conflict – She urged them to refrain from making negative statements about each other in public.
  3. No Interference – She emphasized that they must stay out of each other’s businesses as per their prior agreement.
  4. Honor Family Commitments – She highlighted that family disputes should be handled privately and respectfully.
  • Abhishek Lodha, CEO of Macrotech Developers, welcomed his mother’s letter and stated that he would abide by it. He emphasized that Lodha Developers exclusively owns the brand name and its intellectual property.
  • Abhinandan Lodha, through a spokesperson, maintained that he has always chosen dignity over public disputes and hopes that his family will honor its commitments to him.

Despite the family agreement, the dispute has escalated to legal proceedings:

  • Macrotech Developers has filed a lawsuit claiming that the House of Abhinandan Lodha is using the Lodha name unlawfully.
  • The Bombay High Court has appointed Justice RV Raveendran as a mediator to help resolve the conflict.
  • The case raises questions about brand identity in family-run businesses and the legal weight of family agreements in corporate disputes.

This case highlights the challenges of business succession and brand ownership in family-run enterprises. Some key takeaways include:

    • Clear Legal Agreements – Business families must have well-documented agreements to prevent future conflicts.
    • Brand Ownership Issues – Trademark and intellectual property disputes are common in business families, making legal clarity crucial.
    • The Role of Mediation – Courts often prefer mediation over litigation to resolve family business disputes amicably.
    • Public Perception Matters – High-profile family disputes can affect business reputation and investor confidence.

While the Lodha brothers’ dispute continues, their mother’s intervention underscores the importance of family unity and respecting past agreements. With the case under mediation, it remains to be seen whether the brothers can settle their differences or if the legal battle will intensify further.
